Loan Transferability Issues

The LSTA and LMA and other expert panelists discussed how loan transferability issues arise in both the US and EMEA loan markets and how they are impacting liquidity in the different markets. After briefly outlining the LSTA’s DQ structure, they discussed the strategies used in the different jurisdictions, including DQ lists and whitelists and the increased use of both lists, minimum holds and caps, agent and borrower/sponsor consents, and how they are being applied to participations / sub-participations and credit default swaps.
